Patent Drafting

Patent drafting is the professional core of every patent application – both technical and legal. It defines and describes the innovative technical element of the invention, shows how it differs from existing solutions (the prior art), and sets out its legal scope: the claims. A well-drafted application maximizes the chance of approval and the commercial value of the protection.

What we offer

The Patent Institute provides the full range of services an inventor or entrepreneur needs to take an idea to a real, valuable venture:

  • Developing the invention: at the start, we help upgrade the idea while keeping in mind how each alternative will affect drafting, provisional filing, possible imitations and commercialization.
  • Drafting the application: a robust application, built to make it as hard as possible to design around it.
  • Filing: in Israel, in other countries, PCT international applications and US provisional applications.

We draft in Hebrew, English and other languages – from improving a draft you wrote yourself to a complete professional application.

The “brain trust” – what makes us different

During drafting we hold an additional, in-depth discussion of the idea and its components, using the inventive skills of our professional team. Sometimes the initial review shows that an idea is borderline patentable, too general, or that an earlier patent already exists. In such cases we do not give up immediately: our team has often developed a raw idea to the point where patent protection could be obtained.

A patent is one form of intellectual property

A patent protects an invention that is new, useful, industrially applicable and involves an inventive step. It can protect a product, a process or a system. Intellectual property also includes trademarks, designs, copyright and trade secrets. Scientific discoveries – such as a new star or a mathematical formula – are not inventions and cannot be patented.

The advantage of a patent over a confidentiality agreement: the protection is granted by the state and does not depend on any person or company. In most cases it lasts up to 20 years.
